Experienced legal representation in bankruptcy is essential

Gathering Documents

In the bankruptcy process the collection of documents is absolutely necessary. Documents are required not only for the petition preparation but also to prepare for the 521 (11 U.S.C. section 521) packet which will go to the trustee prior to your meeting of creditors per 11 U.S.C. section 341.  Review of these documents will make sure you are set up for success at the meeting of creditors making for a successful bankruptcy and to secure a discharge.

Preperation of the Bankruptcy Petition

The petition is made up of several schedules and forms.  To secure a discharge the petition must be prepared properly.  Our years of experience in Bankruptcy will make sure your petition is prepared and filed properly.

The 11 U.S.C. section 341(a) hearing - otherwise known as the Meeting of Creditors

Fitzgerald & Campbell will appear with you at your hearing to make sure it goes without any issues.

Bankruptcy Discharge

With our years of experience and hundreds nay thousands of successful petitions filed and millions of dollars of debt discharged we will make sure your bankruptcy process ends in success.... with a discharge of dischargeable debt.

Don't drown in an ocean of debt.  Bankruptcy is legal, safe, and nothing to be ashamed of.

A message from William Campbell - Partner at Fitzgerald & Campbell

THE BANKRUPTCY PROCESS

Bankruptcy is an efficient and safe way to have your debt discharged and to give you a fresh start, and free from collectors pounding on your door.  Life happens and sometime bankruptcy is the best way to resolve  one of the most stressful issues of all - excessive debt.  First, you will get your documents together and we will take those documents and draft your petition.  Then we will go over that petition with you, and we make sure you are protected.  Once that is done, we will file your petition.  We will appear with you at the meeting of creditors and get you your discharge.

Bankruptcy is nothing to be ashamed of and you really should have a lawyer to help you get through the bankruptcy process.  We can help.  Bankruptcy can break the chains of debt and free you from stress.

have you been sued

GENERAL SESSIONS - CIRCUIT COURT - CHANCERY COURT

If you have been sued by a bank, debt buyer, or collector you will probably find yourself in General Sessions Court.  If the lawsuit seeks more than $25,000 you could find yourself in Circuit or Chancery Court.  If you are in General Sessions Court you need to make sure you file a sworn denial.  In the other courts you will have to answer the lawsuit.  Settlement is always an option for you but you should have a lawyer to assist you with that. We can help you settle or litigate.  If you decide to file bankruptcy, as soon as you file your petition, an automatic stay goes into effect stopping the lawsuit in its tracks.  Once you get your discharge the lawsuit is dismissed.

if you are sued or have debt that needs resolved

NOT EVERYONE IS A GOOD FIT FOR BANKRUPTCY

If bankruptcy is not a good fit for you or you do not qualify, Fitzgerald & Campbell can assist you to resolve your debt issues even if you are sued.

William Campbell

Man in a pinstripe suit and blue shirt posing indoors, smiling.

William Campbell began his working career by serving in the United States Army as an infantryman in the 101st Airborne Division. After serving and being honorably discharged, William utilized the G.I. Bill and graduated Cum Laude from California State University Fullerton. Following his graduation with a B.A., William attended Southwestern Law School, passed the California State Bar Exam, and embarked on his journey in practicing law. He is a member of the California and Tennessee State Bar and is also admitted to practice in the United States District Courts for the Central, Southern, Eastern, and Northern Districts of California, as well as the Western, Middle, and Eastern Districts of Tennessee.

William started his legal career practicing criminal law at both the Fresno County Public Defender’s office and ultimately in the Fresno County District Attorney’s Office, where he prosecuted cases ranging from low-level misdemeanors like Driving Under the Influence (DUI) to serious Three Strike Felony cases. In 2009, he transitioned into the Civil Law arena, focusing on the Federal Fair Debt Collections Practices Act and The California Rosenthal Act, which protect debtors from illegal collection practices by creditors. Today, William asserts the rights of debtors, including those facing bankruptcy and seeking a Chapter 7 discharge, against creditors and debt collectors, whether the debt is being alleged in a lawsuit or has already been reduced to judgment. He enjoys the courtroom and especially takes pleasure in presenting cases to juries.

From 2016 to 2022, William Campbell served as an adjunct professor at Trinity Law School, teaching courses in Civil Procedure, Criminal Law, Criminal Procedure, Evidence, and Contracts.
